Visite du Rapporteur spécial sur le droit de réunion pacifique et la liberté d’association à Kairouan
Le Rapporteur spécial sur le droit de réunion pacifique et la liberté d’association, Mr Clement Nyaletsossi VOULE, a mené une visite en Tunisie, du 17 au 20 septembre 2018. Cette visite avait pour objectif d’évaluer l’accès réel de la population à son droit de réunion pacifique et à sa liberté d’association, et de soumettre un rapport d’évaluation au Conseil des Droits de l’Homme en juin 2019.
Lors de sa visite, M. VOULE a pu rencontrer différentes autorités publiques, des associations nationales et internationales ainsi que des activistes qui travaillent sur le sujet, que ce soit dans la capitale Tunis ou dans différentes régions du pays.
Cette visite est considérée comme l’un des mécanismes les plus importants du Conseil des Droits de l’Homme des Nations Unies afin d’évaluer la situation tunisienne et soumettre des propositions et recommandations au gouvernement.
Dans ce contexte, le Forum Tunisien pour les Droits Economiques et Sociaux a accompagné le Rapporteur spécial, ainsi que ses accompagnants, Mme Maria Vivar Aguirre, Mme Christelle Genoud et M. Ahmed Aloui, le représentant du bureau de l’HCDH en Tunisie, lors d’une visite de terrain organisée en deux parties :
- Une rencontre avec les représentants des mouvements sociaux :
Le Rapporteur spécial sur le droit de réunion pacifique et la liberté d’association a pu entendre les témoignages d’activistes ayant été arrêté alors qu’ils participaient à des manifestations, ainsi que leurs familles. Ces témoignages mettaient en avant les abus dont ils ont souffert lors de l’exercice de leur droit constitutionnel à manifester, pour défendre des revendications économiques, sociales, culturelles et environnementales, et rendait compte de l’approche adoptée par les gouvernements successifs depuis 2011 pour gérer ces mouvements de protestation.
Les avocats qui ont participé à cette rencontre ont quant à eux mis en lumière le rôle des enquêteurs et du procureur publics dans la criminalisation des mouvements sociaux et dans l’usage de textes inconstitutionnels, dont des lois et décrets datant de l’ère coloniale. Les participants ont demandé une protection législative pour exercer leur droit à manifester pacifiquement et ont insisté sur la nécessiter de condamner les auteurs de violations des droits des manifestants pacifiques. Ils ont également demandé l’ouverture d’une enquête approfondie sur les victimes de Tataouine et Manouba, afin de mettre fin à la politique d’impunité.
- Une visite de terrain à Jbal Fadhloon :
Le Rapporteur spécial sur le droit de réunion pacifique et la liberté d’association a également visité la région de Jbal Fadhloon, dans le district de Sbikha, et a rencontré certains de ses habitants. La région est connue pour sa vague de mouvements protestataires, qui est née de graves dommages environnementaux.
Les citoyens de Jbal Fadhloon ont raconté les manifestations qu’ils ont organisées et la manière violente par laquelle le gouvernement y a répondu. Ils ont aussi évoqué les procès des manifestants, qui ont abouti à l’acquittement des accusés, mais n’ont pas exigé la réparation des damages qui leur ont été causés, empêchant de créer un précédent contre la répétition de tels comportements.
Le Forum Tunisien pour les Droits Economiques et Sociaux tient à remercier toutes les personnes qui ont contribué à la visite du Rapporteur spécial sur le droit de réunion pacifique et la liberté d’association, les activistes, les familles des manifestants, les citoyens de Jbal Fadhloon, les avocats et la société civile de Kairouan, et espère que les recommandations du Rapporteur spécial seront entendues et que cette visite permettra de soutenir tous les mouvements sociaux, économiques et environnementaux du pays, et en particulier ceux des régions les plus marginalisées.

Visit of the United Nations Special Reporter on the rights to freedom of assembly and association to Kairouan
The United Nations Special Reporter on the rights to freedom of assembly and association, Mr Clement Nyaletsossi VOULE, has conducted a visit to Tunisia from September 17 to 20, 2018. The visit aimed to evaluate the population’s concrete access to their rights of peaceful assembly and of establishing associations and to submit the report of the evaluation to the Human Rights council in June 2019.
During his visit, Mr VOULE has met with several official authorities, national and international organizations and activists working on the subject in the capital Tunis and in different regions of the country.
This visit is considered as one of the most important mechanisms used by the human rights council to observe the current situation in Tunisia and submit propositions and recommendations to the government.
In this context, the Tunisian Forum for Economic and Social Rights accompanied the United Nations Special Reporter on the rights to freedom of assembly and association, Mr Clement Nyaletsossi VOULE, his companions Mrs Maria Vivar Aguirre and Mrs Christelle Genoud and Mr. Ahmed Aloui, the representative of the OHCHR office in Tunisia, on a field visit that comprised two parts:
- A Meeting with the Social Movements Representatives:
The United Nations Special Reporter on the rights to freedom of assembly and association heard the testimonies of activists who had been arrested while participating in social protests and of their families. These testimonies related to the violations they suffered while exercising their constitutional right to peaceful protest to defend their economic, social, cultural and environmental claims and to the approach adopted by the successive governments since 2011 in dealing with these protests.
The lawyers who participated in the meeting shed the light on the role of the primary investigators and of the public prosecutor in criminalizing these protests and on the use of unconstitutional legislative texts and some laws and decrees from the colonial era. Participants demanded legislative protection to exercise their right to peaceful protest and insisted on the necessity of sentencing the offenders of peaceful protesters and of opening a serious investigation about the victims of Tataouine and Manouba, to put end to the policy of impunity.
- A field Visist to Jbal Fadhloon:
The United Nations Special Reporter on the rights to freedom of assembly and association visited the region of Jbal Fadhloon, in Sbikha district and met with some of its inhabitants. The region was known by the wave of peaceful protests which rose due to some serious environmental violations.
The citizens gave their testimonies about the protest they organized and the violent way the government dealt with it. They also talked about the trials of the protesters which ended with the acquittal of the accused without restituting the damage, which could have prevented the reoccurrence of such behaviors.
The Tunisian Forum for Economic and Social Rights wishes to thank all the people who contributed to the program of the visit of the United Nations Special Reporter on the rights to freedom of assembly and association, the social activists, the families of the arrested protesters, the citizens of Jbal Fadhloon, the lawyers and the civil society of Kairouan and hopes that the recommendations of the UN Reporter will be heard and that the results of the visit will provide support to all the social, economic and environmental movements in the different regions of the country and especially in the most marginalized areas.
